Terms of Service — Whyte

These Terms explain the rules for using Whyte. They are written in plain English. They are not legal advice.

1. Use of the app

Eligibility

Your use of Whyte is subject to Apple's App Store Terms of Use and your compliance with applicable laws. You must be old enough to form a binding agreement in your jurisdiction.

Personal use: Whyte is for your personal, non-commercial use. You may not use the app for any illegal purpose or in any way that infringes the rights of others. You may not attempt to reverse-engineer, disrupt, or misuse the app or its services.

Not professional advice: Whyte is a personal reflection and decision-memory tool. It is not legal, medical, financial, or therapeutic advice. Do not rely on it for decisions that require professional advice. If you need such advice, please consult a qualified professional.

2. Whyte Plus subscription

What you get

Whyte Plus is an optional auto-renewable subscription that gives you unlimited decision entries and one reflection per entry. Pricing (e.g. £1.99/month or £14.99/year) is shown in the app and in the App Store. Billing is handled by Apple; we do not collect or store your payment information.

Renewal and cancellation: Your subscription renews automatically at the end of each period (month or year) unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID → Subscriptions settings. Cancellation takes effect at the end of the current period. We do not offer refunds for the current period once it has been charged.

If your subscription ends: Your existing entries and reflections remain on your device (and in iCloud if you use it). You will not be able to create new entries beyond the free limit or add new reflections until you subscribe again or restore a previous purchase.

Changes to subscription: We may change subscription pricing or terms with reasonable notice. Continued use of Whyte Plus after changes constitutes acceptance. We will communicate material changes in the app or at this URL.

3. Your content

Ownership

You own the content you create in Whyte (decision entries and reflections). We do not claim ownership of your content.

Storage and responsibility: Your content is stored on your device and, if you enable it, in your iCloud account. You are responsible for backing up your data. We are not liable for loss of data due to device failure, accidental deletion, or issues with Apple or iCloud services.

Our access: We do not host your content on our servers and do not access it. For more detail, see our Privacy Policy.

4. Disclaimers

The app is provided "as is" and "as available". We do not guarantee that Whyte will be uninterrupted, error-free, or free of harmful components. To the extent permitted by law, we disclaim all warranties (express or implied), including merchantability and fitness for a particular purpose.

5. Limitation of liability

To the maximum extent permitted by applicable law, we (and Apple, where applicable) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profit, arising from your use of the app or subscription.

Our total liability for any claim arising from or related to the app or these Terms shall not exceed the amount you paid us (or Apple for Whyte Plus) in the twelve (12) months before the claim arose, or the minimum amount required by law in your jurisdiction.

6. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms at this URL and may notify you in the app. Your continued use of Whyte after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the app.

7. Termination

You may stop using Whyte at any time by deleting the app or simply ceasing use. We may suspend or discontinue the app or the Whyte Plus offering in accordance with App Store policies and applicable law. Sections that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.

8. Governing law and disputes

These Terms are governed by the laws of England and Wales without regard to conflict of law principles. Any dispute arising from these Terms or your use of Whyte shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Apple

These Terms are between you and the developer of Whyte, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any claims relating to the app or your use of it. Your use of the app must comply with Apple's App Store Terms of Use. To the extent these Terms conflict with Apple's applicable terms, Apple's terms will apply with respect to your use of the App Store and related services.
